1. Company Information

Gostinstvo Online operates this webshop and provides professional horeca equipment and related products.

2. Scope and Applicability

These General Terms & Conditions (“Terms”) apply to all offers, orders, deliveries, and agreements between Gostinstvo Online and its customers, whether acting as:

Consumers (B2C), or
Businesses and professionals (B2B).

By placing an order, the customer confirms having read, understood, and accepted these Terms.

In case of conflict between customer terms and these Terms, these Terms shall prevail, unless expressly agreed otherwise in writing.

3. Products and Intended Use

Gostinstvo Online primarily sells professional horeca materials and equipment, which may be intended exclusively for professional use.

The customer is solely responsible for:

selecting products suitable for the intended purpose,
ensuring compatibility with local regulations,
ensuring proper installation, commissioning, and operation.

Product descriptions, specifications, images, and dimensions are indicative. Minor deviations do not constitute non-conformity or grounds for compensation.

4. Installation & Commissioning Obligations (IMPORTANT)

4.1 Professional Installation Requirement

The following products must be installed and commissioned by a qualified and certified professional installer, in accordance with applicable laws, technical standards, and manufacturer instructions:

400V / three-phase electrical equipment
Gas-powered appliances
Appliances requiring fixed water supply and/or drainage
Refrigeration and cooling equipment
Ventilation, extraction, and exhaust systems

The customer is fully responsible for arranging and paying for professional installation.

4.2 Proof of Installation

Upon request, the customer must be able to provide:

installation invoices,
installer certificates,
commissioning reports.

Failure to provide such proof may result in denial of warranty, service, or liability claims.

4.3 Consequences of Improper Installation

If installation, commissioning, or use:

is performed by an unqualified person,
does not comply with manufacturer instructions,
violates legal or technical standards,

then any warranty, liability, or service obligation is automatically void, to the maximum extent permitted by law.

Gostinstvo Online shall not be liable for damage, malfunction, accidents, or losses resulting from improper installation or use.

5. Prices and Payment

All prices are listed in euros (€) and exclude applicable taxes unless stated otherwise.

Obvious errors (pricing, typographical, or technical) are not binding. Gostinstvo Online reserves the right to cancel or correct such orders.

Orders are processed only after full payment has been received unless specifically agreed otherwise.

6. Shipping and Delivery

6.1 Shipping Fees

Standard shipping fee: €6.95 excluding vat
Free shipping on orders of €125 excluding vat or more

6.2 Delivery Process

Orders are shipped via Pošta Slovenije, UPS, DHL, or GLS. Carrier selection is automatic and cannot be chosen by the customer.

Delivery times are indicative and non-binding.

6.3 Pallet & Freight Deliveries

Large or heavy items are delivered via pallet or freight transport:

Delivery is curbside only, unless expressly agreed otherwise
The carrier may contact the customer to schedule delivery
Placement inside buildings or installation is not included

IMPORTANT:
The customer must inspect the goods and packaging before signing for delivery.
By signing, the shipment is deemed accepted in good condition.

After acceptance, damage claims cannot be submitted on the customer’s behalf.

7. Transfer of Risk

Risk of loss or damage passes to the customer upon delivery.

Gostinstvo Online is not liable for loss, damage, or delay caused by carriers after dispatch.

8. Right of Withdrawal (Consumers only)

Consumers have a statutory right to withdraw within 14 days, unless an exception applies.

Conditions:

Return shipping costs are borne by the customer
Products must be unused, uninstalled, and in original condition
Refunds are issued after inspection

Products intended for professional use, hygiene-sensitive items, installed equipment, or custom-made goods may be excluded from withdrawal rights as permitted by law.

These rights do not apply to businesses.

9. Returns and Refunds

Refunds are processed using the original payment method after inspection and approval.

If returned products show signs of:

use,
installation,
damage,
missing parts,

Gostinstvo Online may refuse or reduce the refund accordingly.

10. Warranty

10.1 Commercial Warranty

Gostinstvo Online provides a 1-year commercial warranty, in addition to statutory rights.

Warranty terms depend on the manufacturer and may include:

parts-only warranty,
carry-in warranty,
manufacturer-specific conditions.

10.2 Warranty Exclusions

Warranty does not apply in case of:

improper or non-professional installation,
installation by non-qualified persons,
incorrect electrical, gas, water, or ventilation connections,
misuse, negligence, or overloading,
lack of maintenance,
unauthorized modifications or repairs.

Consumables and wear parts are excluded unless stated otherwise.

11. Liability Limitation

To the maximum extent permitted by law:

Gostinstvo Online’s total liability is limited to the net value of the order
Liability for indirect, consequential, or economic damages is excluded, including:
- loss of profit,
- loss of turnover,
- business interruption,
- reputational damage.

These limitations apply especially to B2B and professional use.

12. Force Majeure

Gostinstvo Online shall not be liable for delays or failures caused by events beyond reasonable control, including but not limited to:

transport disruptions,
supplier failures,
strikes,
pandemics,
government actions,
natural disasters.

13. Accounts and Misuse

Gostinstvo Online reserves the right to suspend or terminate accounts in cases of fraud, abuse, non-payment, or violation of these Terms.

14. Minimum Age

Orders may only be placed by individuals 18 years or older.

15. Applicable Law and Jurisdiction

These Terms are governed by Slovenian law.

All disputes shall be submitted exclusively to the competent courts in Slovenia.

16. Amendments

Gostinstvo Online reserves the right to amend these Terms at any time.
The most recent version will be published on the website.
